The Clubhouse/Pool is provided for the use of adult residents at Westmaren Condominium. Applicant hereby agrees to comply with the Rules and Regulations herein contained and the Policy Resolution governing Clubhouse and Pool Rental dated August, 2010, which is incorporated by reference herein, governing the use of the clubhouse/pool facilities and any other rules that Westmaren Unit Owners Association Management may impose to protect the welfare and safety of all residents.
1. Applicant shall not use the premises for any unlawful purpose and shall not make or permit to be made any disturbing noises or do or permit any act which will unreasonably interfere with the rights, comforts or convenience of other residents.
2. All parties are to be confined to the clubhouse and pool area. No wet bathing suits or towels are to be permitted in the clubhouse. Non-Westmaren residents/homeowners are not permitted in the pool area at any time.
3. The applicant agrees to assume full responsibility for any damage to the building, furniture, and equipment, whether incurred by applicant, family or invited guests.
4. The applicant further agrees to assume full responsibility for the conduct of his/her guests and will inform them of Westmaren?s Rules and Regulations. Maximum occupancy 60 for clubhouse and 95 for clubhouse and pool.
5. Use of alcoholic beverages shall be in accordance with State/local ABC laws which, among other things, prohibit consumption by individuals under 21 years of age. No alcohol is permitted at parties reserved by Non-Westmaren residents/homeowners.
6. Westmaren Unit Owners Association Management has free access to the clubhouse and pool area at all times and applicant agrees that, should Management personnel deem the use of the Clubhouse/Pool area or actions of occupants undesirable for any reason whatsoever, Management personnel may ask everyone to vacate the premises immediately and take possession of the facilities.
7. Applicant agrees to remove all personal property immediately after party, such as dishes, food, bottles, paper, decorations, and trash of any description. Westmaren Unit Owners Association will not be responsible for the loss of any personal effects, dishes, equipment or food and anything left after the party will be considered abandoned.
8. Applicant agrees to use the clubhouse and pool area during the agreed hours stated above. 9. Applicant agrees to clean the clubhouse facilities and pool area after party and vacuum if needed.
10. Keys to the clubhouse must be returned by 12:00 noon on the first working day after the reserved use.
11. Clubhouse furniture, if moved, must be returned to original position after the reserved use and decorations must not be taped or pinned to walls or ceilings.
12. If a function is canceled within 15 days of the reserved use date, the rental fees will not be reimbursed.
13. The Westmaren Unit Owners Association reserves the right to deduct from the security deposit an amount necessary to cover any costs of cleanup, and shall also deduct the costs of repairs or replacements of any property damaged during the use of the Clubhouse/Pool area. If the security deposit does not fully cover these costs, the Contract Holder shall be billed for the difference, and future use of the Clubhouse /Pool shall be denied until these costs are paid. Any Contract Holder using the Clubhouse/Pool area shall be responsible for any and all damages that occur due to its use.
14. In the event of a failure on the part of any Contract Holder to pay any amount due to the Association for a period in excess of fifteen (15) days, the principal amount unpaid will be charged to the unit owner?s account as assessments and/or other applicable provisions of law.
15. In the event that a Clubhouse or pool entrance key is lost, the Contract Holder will be responsible for the entire cost of re-keying the exterior doors.
16. It is understood that the Contract Holder agrees to indemnify the Association, its directors, officers, agents and employees, and save them harmless from and against any and all liability, damage, expense, cause of action, suits, claims or judgments arising from injury to person or property occurring in or about the premises and upon the adjoining sidewalks, streets or ways which may arise from the Association?s ownership of the premises, from any action or omission of the Contract Holder its agents, employees, invitees, or licenses, or from any cause whatsoever.
